White House Issues New AI Policy Memos, Emphasizing Innovation, Governance, and Public Trust

The White House Office of Management and Budget (OMB) recently released two memos, M-25-21 and M-25-22, outlining updated guidance on the use and acquisition of artificial intelligence technologies across the federal government. While these documents replace previous memos issued under the Trump administration, they also mark a refinement of the Biden Administration’s earlier AI policy approach. Specifically, they shift from high-level principles- such as those outlined in the Biden Administration’s Blueprint for an AI Bill of Rights– to enforceable, operational requirements that agencies must now integrate into both AI governance and procurement processes.

The first memo, M-25-21, establishes concrete guardrails for federal AI use, emphasizing responsible innovation, strong governance, and the importance of maintaining public trust. The second memo, M-25-22, updates the acquisition process, reinforcing requirements around risk management, performance tracking, and sustaining a competitive AI technology marketplace. Importantly, agencies must ensure that all AI technologies undergo rigorous testing and impact assessments, with non-compliant tools subject to potential contract termination.

Together, these memos reflect a maturing federal AI strategy—moving from conceptual frameworks to actionable policy infrastructure—designed to ensure responsible, accountable, and transparent AI deployment across government operations.
